Introduction

This Privacy Policy explains how EverAge Labs (“EverAge Labs,” “we,” “us,” or “our”) collects, uses, shares, and protects your personal information when you visit everagelabs.com, purchase our products, or otherwise interact with us (together, the “Platforms”). It also explains your privacy rights and how to exercise them.

If we change how we handle your personal information, we will update this Policy and, where appropriate, notify you — for example, by posting an updated Policy on the Website or, for material changes, by email. Please review this Policy periodically.

1. What personal information we collect

We collect personal information from and about you from several sources:

Information you provide directly, such as:

  • Contact details: Name, email address, phone number, shipping and billing address.
  • Account credentials: Username and password.
  • Order and transaction information: Products purchased, subscription status, order history.
  • Payment information: Processed by our payment providers (see below).
  • Communication preferences: Any information you share when you contact customer support, respond to a survey, leave a review, or participate in a promotion or referral.

Information collected automatically when you use the Platforms, such as:

  • Device and technical information: IP address, browser type and version, operating system, device identifiers, time zone.
  • Usage information: Pages viewed, links clicked, referring URLs, dates and times of visits, and interactions with our content and ads.

Much of this automatic information is collected through cookies and similar technologies (see Section 5).

Information from third parties:

Such as our payment processor (for fraud and identity verification), analytics and advertising partners, and fulfillment providers.

Payment details

We use third-party payment processors (via our Shopify storefront). We do not store your full payment card number on our own servers except where necessary to process refunds.

A note on health information

We do not require you to share medical information to purchase our products, and we ask that you not send us sensitive health details through general customer-service channels. If you voluntarily provide health-related information (for example, when asking a product question), we use it only to respond to you.

Children

Our products and Platforms are intended for adults. We do not knowingly collect personal information from anyone under 18 (or under 13 as defined by the Children's Online Privacy Protection Act). If you believe a minor has provided us information, contact us and we will delete it.

2. Why we use your personal information

We use your personal information to:

  • Fulfill your orders and contract with you: Set up and manage your account, process payments and subscriptions, arrange shipping, handle returns and refunds, and send order- and account-related (transactional) messages.
  • Provide customer support: Respond to your inquiries effectively.
  • Operate, improve, and secure our Platforms: Including analytics, troubleshooting, fraud prevention, and protecting our rights and the safety of our customers.
  • Market to you: Send newsletters, offers, and product information by email or SMS where you have given any consent required by law, and personalize the content and ads you see.
  • Comply with legal obligations: Respond to lawful requests from government or law enforcement authorities.

We rely on your consent for certain marketing activities and cookies; you can withdraw that consent at any time (see Sections 5 and 6).

3. How we share your personal information

We do not sell your personal information for money. We share personal information as follows:

  • Service providers: Who perform functions on our behalf under contract — for example, our e-commerce platform (Shopify), payment processors, shipping and fulfillment partners (3PL), email/SMS providers (such as Klaviyo), customer-service tools, and analytics providers. They may use your information only to provide services to us.
  • Advertising and analytics partners: Including social media and search platforms, so they can help us measure and deliver relevant advertising. This may involve sharing identifiers such as a hashed email or device ID. Depending on your state's law, some of this activity may be considered “sharing” or a “sale” of personal information for targeted advertising, and you can opt out (see Section 6).
  • Legal and safety: With courts, regulators, or law enforcement where we reasonably believe it is necessary to comply with the law, enforce our Terms, or protect the rights, property, or safety of EverAge Labs, our customers, or others.
  • Business transfers: With a prospective or actual buyer if we are involved in a merger, acquisition, financing, or sale of assets.

4. How long we keep your information

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, to comply with our legal, tax, and accounting obligations, to resolve disputes, and to enforce our agreements. When it is no longer needed, we delete or de-identify it.

5. Cookies and similar technologies

We and our partners use cookies, web beacons, and similar technologies to operate the Website, remember your preferences, analyze traffic and performance, and deliver and measure advertising. Categories include:

  • Strictly necessary cookies: Required for the Website and checkout to function.
  • Analytics/performance cookies: Help us understand how the Website is used (for example, via Google Analytics).
  • Functionality cookies: Remember your preferences and settings.
  • Advertising/targeting cookies: Used, often by third parties, to deliver and measure relevant ads.

6. Your privacy rights and choices

  • Marketing emails: You can unsubscribe at any time using the link in any marketing email. You will still receive transactional messages about your orders and account.
  • SMS/text messages: If you opt in to text messages, message and data rates may apply. You can opt out at any time by replying STOP to any message; reply HELP for help.
  • Interest-based advertising: See the opt-out tools in Section 5.

State privacy rights (California and other US states)

Depending on where you live, you may have the right to:

  • Know/access the personal information we hold about you and how we use and share it;
  • Correct inaccurate personal information;
  • Delete your personal information;
  • Opt out of “sales” or “sharing” of personal information and of targeted advertising;
  • Portability — receive a copy of certain information; and
  • Non-discrimination for exercising your rights.

To exercise these rights, contact us. We will verify your request and respond within the timeframe required by law. You may use an authorized agent where permitted. If we deny a request, you may have the right to appeal.

7. How we protect your information

We use administrative, technical, and physical safeguards designed to protect your personal information, including SSL/TLS encryption for data transmitted through the Website, and we limit access to those who need it to provide products and services to you. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

The Platforms may contain links to third-party websites. We are not responsible for the privacy practices or content of those sites. Please review their policies before providing any personal information.
